Assault and Battery Defense Attorney

in Fort Lauderdale, Florida
A Weak Defense Doesn’t Just Lose Cases. It Loses Futures.
If you have been charged with assault or battery in Florida, the clock is already running against you. Whether the incident stemmed from a physical confrontation, a domestic dispute, or allegations of aggravated or armed battery, what happens next depends entirely on the strength of your defense.

What’s at Stake Right Now?

Assault and battery charges can escalate fast.
What may have started as an argument, misunderstanding, bar altercation, or emotionally charged moment can suddenly leave you facing consequences that follow you long after the case is over.
You may be asking:
  • Will I go to jail?
  • Can this charge become a felony?
  • Will this affect my job or professional license?
  • What if I was defending myself?
  • What if the allegations aren’t accurate?
  • Can the charges be dropped or reduced?
  • What if law enforcement only heard one side of the story?

In many cases, law enforcement arrives after the fact, emotions are high, and an arrest is made based on incomplete or one-sided information.

That is exactly where the right defense strategy makes the difference.

At Mayersohn Law Group, we defend clients against the full spectrum of assault and battery charges throughout Fort Lauderdale and Florida.

Frequently Asked Questions About Assault & Battery Charges in Florida

VIEW ALL FAQs

Can assault charges be dropped in Florida?

Yes. Charges can be dismissed by the State Attorney if evidence is insufficient, if self-defense is clearly established, or if pretrial motions succeed. An experienced defense attorney can evaluate your specific facts and identify the strongest path to dismissal or reduction.

What happens if the alleged victim wants to drop the charges?

The decision to prosecute belongs to the State of Florida, not the alleged victim. Even if the complaining witness later changes their story or asks for the case to be dismissed, prosecutors may still move forward with criminal charges. This is especially common in domestic violence cases.

Does Stand Your Ground apply to my case?

It depends on the specific facts: where the incident occurred, whether you were in a place you had a legal right to be, the nature of the threat, and your response. Our attorneys analyze Stand Your Ground applicability in every assault and battery case we handle.

What evidence is commonly used in assault and battery cases?

Prosecutors may rely on witness statements, surveillance footage, 911 recordings, body camera footage, text messages, medical records, photographs, social media activity, and forensic evidence when building assault and battery cases.

What happens if I am charged with battery on a law enforcement officer?

Battery on a law enforcement officer is a felony charge in Florida regardless of whether any injury occurred. The stakes are immediately higher than a standard battery charge, and you should contact an attorney immediately.

What if I was falsely accused of assault or battery?

False allegations can arise from relationship disputes, divorces, custody battles, business conflicts, or misunderstandings. A strong defense often involves exposing inconsistencies, uncovering motives, and challenging the credibility of the allegations and the witnesses behind them.

Will a battery conviction affect my professional license?

Many professional licensing boards, including those governing healthcare, law, financial services, and education, require disclosure of criminal convictions and may take disciplinary action. The sooner you have an attorney involved, the more options exist to protect your license alongside your criminal defense.

What if I acted in self-defense?

Self-defense is one of the most commonly raised defenses in assault and battery cases, and Florida law provides strong protections for individuals who reasonably believed they or someone else was in danger. Whether Stand Your Ground immunity applies or self-defense is raised at trial, presenting this argument effectively requires an attorney who understands how Florida courts evaluate the evidence.
