Guardianship Attorney

in Fort Lauderdale, Florida
When someone you love can no longer make decisions for themselves, the people around them have to decide what happens next.
Whether the cause is dementia, a traumatic injury, severe mental illness, or another incapacitating condition, the window to act may be shorter than you think, and the decisions made now will affect your loved one’s safety, finances, and independence for the rest of their life.

What Families in This Situation Are Up Against

Guardianship cases rarely arrive at a convenient time. They come in the middle of a family crisis, a medical emergency, or a dispute that has already gone too far.

There are the situations we hear most often:

  • A parent with dementia is being financially exploited and there is no legal authority in place to stop it
  • A loved one suffered a brain injury and can no longer manage their own medical or financial decisions
  • Family members disagree about who should serve as guardian and the conflict is escalating
  • An existing guardian may be mismanaging assets, isolating your loved one, or abusing their authority
  • You or a loved one has been served with a petition alleging incapacity and need to understand your rights
  • A vulnerable adult is in immediate danger and you need legal intervention now

At Mayersohn Law Group, we help families across Fort Lauderdale, Broward County, Miami-Dade, Palm Beach County, and statewide navigate Florida guardianship proceedings with clarity and purpose, whether you need to establish guardianship urgently, contest a proceeding, or address concerns about an existing guardian’s conduct.

Florida Guardianship Options

Not sure which applies to your situation? Call 954-765-1900

1

Plenary Guardianship

When the court finds that a person is totally incapacitated and unable to exercise any of the rights being delegated, it may appoint a plenary guardian with broad authority over healthcare, residential placement, and financial matters. Under Chapter 744, Florida Statutes, plenary guardianship is the most comprehensive form available and is reserved for situations where no less restrictive alternative is sufficient to protect the ward’s interests.

2

Limited Guardianship

When a person retains some ability to make decisions independently, the court may appoint a limited guardian with authority over only the specific rights the ward cannot manage. Florida law favors limited guardianship whenever it is sufficient to meet the ward’s needs, preserving as much of the ward’s independence as the situation allows.

3

Emergency Temporary Guardianship

When a vulnerable person faces immediate risk, whether from financial exploitation, a medical emergency, or a threat to their physical safety, Florida law allows for the appointment of an emergency temporary guardian without waiting for the full incapacity hearing. Emergency guardianship can be established for up to 90 days while the full proceeding is pending. It is one of the most powerful and most underutilized tools in Florida elder law. When time is critical, it can be the difference between protecting someone and allowing serious harm to continue.

Fort Lauderdale Guardianship Attorneys Who Handle the Full Proceeding

We understand what Florida courts require, what the process actually looks like, and what it takes to protect a vulnerable person while navigating the deeply personal circumstances these matters always involve.

Frequently Asked Questions About Guardianship in Florida

VIEW ALL FAQs

When is guardianship necessary?

Guardianship may be necessary when a person can no longer safely make decisions due to dementia, Alzheimer’s disease, a traumatic brain injury, developmental disabilities, mental illness, or other serious cognitive or physical impairments. The court must find that less restrictive alternatives are not sufficient before appointing a guardian.

How do I become a legal guardian in Florida?

The process begins with a petition to the circuit court, followed by an examining committee evaluation, an incapacity hearing, and, if incapacity is found, a formal guardian appointment. The full process typically takes several months. Emergency guardianship can be established much faster when there is immediate risk to the person’s health, safety, or finances.

What is a ward in a Florida guardianship case?

The ward is the person who is the subject of the guardianship proceeding. The ward’s legal capacity is evaluated by the court, and any rights transferred to the guardian are specified by court order.

What is the difference between plenary and limited guardianship?

Plenary guardianship transfers all specified legal rights from the ward to the guardian and is appropriate when incapacity is total. Limited guardianship transfers only specific rights and is legally preferred when the ward retains some decision-making capacity.

What rights can a person lose under guardianship?

Depending on the court’s findings, a ward may lose the right to manage finances, enter contracts, determine their place of residence, consent to medical treatment, or exercise other personal rights. The court order specifies exactly which rights are transferred.

Can guardianship be contested in Florida?

Yes. The alleged incapacitated person has the right to contest the finding of incapacity. Family members may contest who is appointed as guardian. Existing guardians can be challenged and removed when they are not acting in the ward’s best interests. Our attorneys represent all parties in contested proceedings.

What is emergency temporary guardianship?

An emergency temporary guardian can be appointed without the full incapacity hearing when a vulnerable person faces immediate risk to their health, safety, or financial welfare. Emergency guardianship is valid for up to 90 days and is one of the most important tools available when a situation cannot wait for the standard process.

How long does the guardianship process take in Florida?

A full guardianship proceeding typically takes several months from petition to appointment, depending on court scheduling and whether the matter is contested. Emergency temporary guardianship can be established significantly faster when there is an immediate threat.
