Paternity Attorney

in Fort Lauderdale, Florida
Protect Your Rights as a Father
For many fathers, paternity is about more than a DNA test. It’s about having a relationship with your child, being involved in important decisions, and protecting your rights as a parent.
If paternity has not been legally established, you may have no enforceable right to time-sharing, custody, or involvement in your child’s life.

On the other hand if you’ve been named as a father and believe that determination is wrong, you may be facing financial obligations that could affect you for years.

Are You Being Kept Out of Your Child's Life?

Many fathers contact us because they feel powerless.

They know they’re the child’s father, but they have no legal rights.
They may be asking:
  • How do I get custody or time-sharing rights?
  • Can I be involved in decisions about my child?
  • What if the other parent won’t cooperate?
  • How do I legally establish paternity?
  • What are my options if paternity is being disputed?

The good news is that establishing paternity can open the door to important parental rights. Our firm helps fathers take the legal steps needed to protect their relationship with their children.

At Mayersohn Law Group, we help clients establish, challenge, and disestablish paternity throughout Fort Lauderdale and South Florida.

Found Out You May Not Be the Father?

Few situations are more upsetting. You may have recently learned information that makes you question whether you’re the biological father of a child. You may already be paying child support, or you may already have a court order in place.

If you believe a paternity determination is incorrect, it’s important to act quickly. Florida law may provide options in certain situations, but waiting too long can limit those options. We help clients evaluate their legal position and determine the best path forward.

Establishing Paternity Is About More Than Child Support

Many people assume paternity cases are only about financial obligations. They aren’t. For fathers, establishing paternity is often the first step toward seeking time-sharing rights, participating in important decisions, protecting the parent-child relationship, creating a parenting plan, and building a legally recognized relationship with a child. If you want an active role in your child’s life, establishing paternity is often where that process begins.

1

When Paternity Is Disputed

Not every case is straightforward. Sometimes parents disagree about who the biological father is, one parent refuses to cooperate, or there are questions that only DNA testing can answer. When disputes arise, experienced legal representation can help protect your rights and ensure the process moves forward properly. We guide clients through every stage of contested paternity proceedings.

2

Why Timing Matters

Many paternity issues become harder to resolve the longer you wait. Important deadlines may apply, financial obligations may continue to grow, and opportunities to protect your rights may become more limited. The sooner you understand your legal options, the better positioned you may be.

Frequently Asked Questions About Paternity in Florida

VIEW ALL FAQs

Does signing a birth certificate establish paternity in Florida?

Not by itself. In Florida, paternity for unmarried parents is legally established either through a signed and filed Acknowledgement of Paternity form or through a court order, not simply by appearing on a birth certificate. However, a signed Acknowledgement of Paternity does authorize adding the father’s name to the birth certificate and carries the same legal force as a court order once the rescission period has passed.

Can paternity be established without going to court in Florida?

Yes, when both parents are in agreement. An Acknowledgement of Paternity form can be signed at the hospital at birth or later through the Florida Department of Health. This voluntary process establishes legal paternity without court involvement. When there is any dispute, however, a court proceeding and DNA testing are required.

How accurate is DNA testing for paternity?

DNA paternity testing is extremely accurate; modern testing can establish biological paternity with greater than 99.9% certainty, and exclusion results are considered definitive. Florida courts routinely rely on DNA testing under § 742.12 to resolve disputed paternity cases.

What rights does an unmarried father have before paternity is established?

None that are legally enforceable. Until paternity is legally established, an unmarried father has no right to time-sharing, no standing in adoption proceedings involving his child, and no legally recognized parental relationship under Florida law. Establishing paternity is the essential first step to securing any parental rights.

Can past child support be recovered after disestablishing paternity?

Generally no. Under Florida’s disestablishment statute § 742.18, if a petition is granted, child support obligations may be terminated going forward, but support that accrued before the petition was filed is typically not recoverable. This makes timing critical, the sooner you act after learning new information, the better your position.

I'm listed on the birth certificate, but the other parent won't let me see my child. What can I do?

Being listed on the birth certificate alone doesn’t guarantee enforceable time-sharing rights unless paternity has also been legally established through an Acknowledgement of Paternity or a court order. If paternity is established but the other parent still isn’t honoring time-sharing, you may need to petition for a parenting plan or enforce an existing one through the court.

How long does it take to establish paternity in Florida?

It depends on whether the case is contested. A voluntary Acknowledgment of Paternity can be completed quickly, sometimes at the hospital at the time of birth. Contested cases involving DNA testing and a court proceeding typically take longer, often a few months, depending on the court’s schedule and how cooperative the other party is.
